Florida operates under a no-fault divorce system, meaning couples can file for dissolution of marriage without proving wrongdoing. Property is divided under equitable distribution, which allocates marital assets based on factors like the length of the marriage and each party’s economic circumstances, not necessarily a 50/50 split. On alimony, Florida Statute 61.08, effective July 1, 2023, abolished permanent alimony. Durational alimony is now capped at 50%, 60%, or 75% of the length of the marriage for marriages lasting fewer than 10 years, 10–20 years, or 20 years or longer, respectively, with awards limited to a maximum of 35% of the difference between the spouses’ net incomes.
