How Florida Law Defines Manslaughter
Under Florida Statute 782.07, manslaughter is the killing of another person by act, procurement, or culpable negligence (grossly reckless conduct that a reasonable person would know creates a serious risk of harm) without lawful justification, in cases that don’t qualify as excusable homicide or murder. Unlike first-degree or second-degree murder, manslaughter doesn’t require premeditation or a depraved mind. That distinction matters, but it doesn’t make the charge minor.
Standard manslaughter is a second-degree felony, carrying potential penalties of up to 15 years in prison, 15 years of probation, and a $10,000 fine. The charge can be elevated significantly depending on the circumstances:
Firearm or Weapon Use
If a weapon or firearm was involved, the charge is reclassified to a first-degree felony, potentially exposing a defendant to up to 30 years in prison.
Aggravated Manslaughter
When the victim is an elderly or disabled adult, a child under 18, or certain first responders performing their duties, the charge becomes aggravated manslaughter, also a first-degree felony with the same potential 30-year exposure.
